These terms govern the relationship between Permata Senja (we, us, the firm) and any person who engages our legal services or uses this website. Please read them carefully. By instructing us or submitting an enquiry through this website, you agree to these terms.
1. Our Services
Permata Senja provides pension protection legal services in Malaysia. Our current service offerings are:
- Plain-Language Pension Briefing — RM 340 per session.
- Employer Pension Dispute Correspondence — RM 720.
- Multi-Generational Pension Plan — RM 970.
The scope of each service is as described on this website and in any written engagement letter we provide. Where there is any inconsistency, the written engagement letter shall prevail.
2. Engagement and Instructions
A formal engagement begins when you have received and agreed to our written engagement letter and, where applicable, paid the agreed fee or deposit. An initial telephone enquiry or website submission does not constitute an engagement and does not create a solicitor-client relationship.
We accept instructions from adults of legal capacity. Where a client is assisted by a family member or carer, we require confirmation from the client themselves that they wish to be represented.
3. Fees and Payment
Our fees are as stated above and in your engagement letter. Fees are quoted inclusive of applicable taxes unless otherwise stated. Payment is due as specified in the engagement letter, which may require payment in full prior to a session or on a staged basis for multi-session engagements.
We accept payment by bank transfer and cash. Receipts are provided for all payments. We do not accept cryptocurrency or third-party payment platforms.
If additional work is required beyond the original scope, we will discuss this with you before proceeding and obtain your agreement to any additional fee.
4. Cancellation and Rescheduling
We understand that circumstances change, especially for older clients and those with family commitments. We ask for at least 48 hours' notice where possible if you need to reschedule a session.
Sessions cancelled with less than 24 hours' notice may incur a charge of 50% of the applicable session fee, at our discretion and in consideration of the circumstances.
If we need to reschedule a session on our side, we will contact you promptly and arrange an alternative time at no additional cost.
5. Our Obligations to You
We will:
- Act in your best interests in the course of the services we have been engaged to provide.
- Keep your affairs confidential in accordance with our professional obligations.
- Explain matters in plain language and ensure you have understood what has been discussed before concluding a session.
- Provide you with copies of any correspondence sent on your behalf.
- Notify you of any development that may affect your matter without undue delay.
Our services are governed by the Legal Profession Act 1976 and the rules of the Malaysian Bar.
6. Your Obligations
To enable us to serve you well, you agree to:
- Provide accurate and complete information relevant to your matter.
- Inform us promptly of any change in circumstances that may affect your matter.
- Pay agreed fees in the manner and at the time specified.
- Not seek to obtain legal advice in relation to your matter from another firm simultaneously without informing us.
7. Limitation of Liability
Our advice relates to the specific circumstances you have described to us. We are not liable for loss arising from information you have withheld, misrepresented, or communicated inaccurately.
We carry professional indemnity insurance in accordance with Malaysian Bar requirements. Nothing in these terms limits our liability for fraud, wilful default, or any liability that cannot be excluded by law.
8. Confidentiality
All information you share with us is held in confidence. We will not disclose your affairs to any third party without your authority, except where we are required to do so by law, court order, or our professional regulatory obligations.
9. Website Use
The content on this website is provided for general informational purposes and does not constitute legal advice. No solicitor-client relationship arises from your use of this website alone.
We have taken reasonable care to ensure the accuracy of the information on this website but cannot accept responsibility for errors or omissions. Legal requirements change and information may not reflect the most current position of the law.
10. Complaints
If you are dissatisfied with any aspect of our service, we ask that you raise the matter with us in the first instance. We take all concerns seriously and will respond within five working days.
If a complaint cannot be resolved to your satisfaction, you may contact the Malaysian Bar's Complaints Committee. Details are available at www.malaysianbar.org.my.
11. Governing Law
These terms are governed by the laws of Malaysia. Any dispute arising from our engagement shall be subject to the jurisdiction of the courts of Malaysia.
12. Changes to These Terms
We may update these terms from time to time. The terms applicable to your engagement are those in force at the date of your engagement letter. Updated terms apply to new engagements only.
